The City of Bonney Lake will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to people who use wheelchairs.
Sometimes an individual with a disability may not be able to access a state or local government’s web content or mobile apps even if they meet WCAG 2.1, Level AA. If this happens, the City of Bonney Lake is not required to make more changes to its web content or mobile apps that meet the technical requirement, but the city must still satisfy its other obligations under the ADA to provide individuals with disabilities with effective communication, reasonable modifications, and an equal opportunity to participate in or benefit from their services, programs, and activities. The City of Bonney Lake engages in a cooperative dialogue with the individual making the accommodation request concerning their accommodation needs, potential accommodations and any potential undue hardship this may pose on the city, and alternative accommodations if necessary.
The Americans with Disabilities Act (ADA), signed on July 26, 1990, is a comprehensive civil rights law protecting the rights of people with disabilities. The ADA is divided into five titles to ensure equal opportunity and access for individuals with disabilities in the areas of employment (Title I), state and local government services (Title II), public accommodations (Title III), telecommunications, retaliation, and other provisions (Titles IV and V).

Effective Communication
Upon request, Bonney Lake will provide auxiliary aids and services to allow effective communication in its programs, services, and activities. Examples include ASL interpreters, Braille, and assistive listening devices.
Modifications to Policies and Procedures
City of Bonney Lake will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services, and activities. For example, individuals with service animals are welcomed in City of Bonney Lake offices, even where pets are generally prohibited.
Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City of Bonney Lake should contact the ADA Coordinator as soon as possible but no later than 72 hours before the scheduled event.
The ADA does not require the City of Bonney Lake to take any action that would fundamentally alter the nature of its programs or services or impose an undue financial or administrative burden.
Title II of the Americans with Disabilities Act (ADA) of 1990 prohibits all state and local governments from discriminating based on disability. Cities and other government agencies are required to have an ADA self-evaluation and transition plan when they grow beyond a threshold of 50 employees.
The City of Bonney Lake ADA Transition Plan (adopted May 26, 2020) identifies deficiencies in City policies, procedures, and physical assets, and provides guidance to correct those deficiencies and remove accessibility barriers. The Transition Plan outlines progress to date, and it identifies the necessary steps to bring City facilities and programs into compliance with ADA regulations. This Transition Plan is intended to be a living document that will be updated regularly to track ongoing progress toward compliance.
This grievance procedure is established to meet the requirements of the ADA. It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the City of Bonney Lake.
The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number, email address of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint will be made available for persons with disabilities upon request. The complaint should be submitted as soon as possible, preferably within 60 calendar days of the alleged violation to:
Within 15 calendar days after receipt of the complaint, the ADA Coordinator, or designee will communicate with the complainant to discuss the complaint and the possible resolutions. Within 15 calendar days of the meeting, the ADA Coordinator will respond in writing, and where appropriate, in format that is accessible to the complainant, such as audio recording or transcript. The response will explain the position of the City of Bonney Lake and offer options for substantive resolution of the complaint.
If the response by the ADA Coordinator does not satisfactorily resolve the issue, the complainant may appeal the decision within 15 calendar days after receipt of the response to the City Administrator or designee.
Within 15 calendar days after receipt of the appeal, the City Administrator or designee communicate with the complainant to discuss the complaint.
Within 15 calendar days after the meeting, the City Administrator or designee will respond in writing, and, where appropriate, in a format that is accessible to the complainant, with a final resolution of the complaint.
All written complaints received by the ADA Coordinator, City Administrator or designee, and responses from these two offices by these two offices will be retained by the City of Bonney Lake for at least six (6) years.
